Under Kentucky law, whether a juvenile offense may be expunged depends on what KRS Chapter the offense was adjudicated or determined under:
KRS CHAPTERS THAT MAY BE ELIGIBLE FOR EXPUNGEMENT:
These typically include misdemeanors, status offenses and violations and mental health issues.
KRS CHAPTERS THAT ARE NOT ELIGIBLE FOR EXPUNGEMENT:
These typically include felonies and certain other crimes.
In addition, a person is barred from receiving an expungement for a felony or juvenile offense after the person’s unconditional release from commitment or the court’s jurisdiction over the person has terminated. KRS 610.330
