Hearing on Summary Judgment Over Abortion Laws
On Monday, May 13, 2024, Judge Brian Edwards heard oral arguments on competing motions for summary judgment. Our clients face significant hindrances due to Kentucky’s state laws. Kalb, for instance, worries about the legal status of nine embryos she currently has in storage. Kentucky defines these embryos as human beings. This makes their disposal potentially subject to criminal prosecution. This legal ambiguity places a heavy burden on those relying on in vitro fertilization (IVF) to grow their families, as they must navigate the risk of severe legal consequences.
